- Gruma Singapore Pte. Ltd., and/or each of our respective related corporations (as the term is defined in the Companies Act 1967), affiliates and associated companies, (hereinafter “Gruma” or “we” ) is responsible for the treatment of the personal data (hereinafter, “Data”) it collects, records, holds, stores, uses, discloses and/or process (collectively referred to as “Process”) concerning the individuals in their specific categories in connection with your dealings and relationship with us, namely Personnel, Customers (consisting of both Customer-Dealer and Customer-Consumer, unless stated otherwise) and Suppliers (collectively, “Data Subjects”) to whom such Data corresponds.

- Collection, Sources and Purpose of Data
- Gruma is engaged in the business of elaboration, production, trading, distribution, import and export of corn and wheat flour, as well as corn and wheat flour based products. Because of this, Gruma interacts and has interacted with several individuals, who are the Data Subjects of the Data that at any time were collected from them.
- Therefore, Gruma hereby informs you the type of Data that it Processes, the sources which the respective Data were obtained from, as well as the purpose of the Processing of such Data.
- To the extent that you disclose to Gruma any personal information and/or personal data (whether or not coming within the definition of Data above) of another individual, we shall assume, without independent verification, that you have obtained such individual's consent for the disclosure of such information and/or personal data as well as the Processing of the same in accordance with this Privacy Policy.
- Note that from among all the Data collected from the Data Subjects and/or their relatives, there may be information deemed as sensitive personal data, including but not limited to physical or mental health or condition of the Data Subjects, political opinions, religious beliefs or other beliefs of a similar nature, the commission or alleged commission of the Data Subjects of any offence, and you consent to Gruma to Processing this Sensitive Personal Data as set out in this Privacy Policy.
- Data of the Personnel
- With respect to Data of the PERSONNEL (i.e. employment applicants, employees, former employees, interns), Gruma Processes information obtained from the Personnel in a personal, direct manner, or through our website, third party administrators, your previous employers, employment agencies, background checks and professional or personal reference, or other sources which we may see fit from time to time. Such information may include, but is not limited to, full name, address, telephone, email, career experience, non-criminal records certificate, union membership, proof of studies, proof of domicile and copy of an official ID.
- All this information is collected with respect to administering your employment relationship with us and managing human resource processes, or such other purposes as we deem necessary appropriate from time to time, including to (i) determine the remuneration and/or employment benefits and to make such payment, (ii) to communicate with and to locate the Personnel, (iii) to identify the Personnel, (iv) to prepare a career profile for examination and training purposes, and (v) to make an employment recommendation. Gruma may also request the full name and telephone number of direct relatives (i.e., ascendants and/or descendants and/or collateral relatives and/or spouse) for employment references purposes.
- Gruma may collect information regarding any bank account of the PERSONNEL for the purpose of facilitating the payment, whether at the bank or through wire transfer, of any service rendered and/or supply of any good provided.
- Gruma may request at any time from any of the Personnel, any additional information as it deems fit and may make evaluations of socioeconomic, psychometric and/or medical (health) for internal purposes, in order to define a Personnel’s profile for purposes of determining and/or providing some kind of allowance in the employment benefits and/or support in particular cases.
- Gruma may also request and/or collect Data from the PERSONNEL and/or from their direct relatives information regarding suffered illnesses and/or accidents (health) of the Personnel, as well as of the automobiles they use. The information is, amongst others, to evaluate, quote and, if applicable, provide any type of Medical Insurance and/or Life Insurance and/or Automobile Insurance, as some sort of employment benefit attending to their title and/or position and/or duties.
- Gruma may also collect any such information as we deem necessary or appropriate from time to time in connection with the Personnel's employment with us.
- Data of Customers
With respect to the Data of CUSTOMERS, Gruma Processes the Data from two different types of customers: - Customer-Dealer, from whom it may be requested directly or through our website or third party administrators, or other sources which we may see fit from time to time. Customer-Dealers may be requested information including but not limited to, full name, address, telephone and/or email, website, bank account data, copy of an official ID. The Data is required in order to (i) determine the consideration and/or remuneration for the supply of the products and/or the services provided by Gruma, (ii) make the corresponding collection and payment, (iii) communicate with and to locate the Customer-Dealer, and (iv) such other purposes as we deem necessary appropriate from time to time.
- Customer-Consumer, from whom it may be requested directly or through our website or third party administrators, or other sources which we may see fit from time to time. Customer-Consumers may be requested information including but not limited to, full name, address, telephone and/or email, date of birth, for product evaluation and/or brands and/or services of Gruma. The Data is required in order to (i) obtain a result in market surveys, (ii) send them advertising material and/or notices, via email and/or any other media, and (iii) such other purposes as we deem necessary appropriate from time to time,
- If you are receiving promotional information about Gruma and do not wish to receive this information any longer, you may remove your name from our mailing list calling us on 606 798 6945 and asking to be removed from our mailing list.
- Gruma may also collect any such information as we deem necessary or appropriate from time to time in connection with your dealings and/or relationship with us.
- Data of Suppliers
- With respect to the Data of SUPPLIERS, Gruma may Process the Data obtained from the Suppliers or through our website or other sources which we may see fit from time to time. This includes, but is not limited to, full name, address, telephone, email, quotation and/or budget, proof of domicile and copy of an official ID. The Data is required in order to identify and locate the Suppliers, to determine the consideration and/or remuneration for the services rendered and/or the goods supplied to Gruma, as well as to make the payments referred to above.
- In the event that information regarding any bank account of the Suppliers is collected, such data will be collected solely for the purpose of facilitating the payment, whether at the bank or through wire transfer.
- Gruma may also collect any such information as we deem necessary or appropriate from time to time in connection with your dealings and/or relationship with us.
- Providing Data
- Except for Data collected from Customer-Consumer which is Processed for marketing or promotional purposes, it is obligatory for the Data Subjects (whether a Supplier, Customer or Personnel) to provide the categories of Data which we requested from you for the purposes set out in Paragraph 1 above. Failure to provide Data referred to in this Privacy Policy, will result in:
- in respect of the Personnel, an impact on your ability to enjoy and/or participate in the full employment-related benefits and entitlements which we provide to our employees or in the case of prospective employees, our ability to offer employment to you;
- in respect of the Customers and Suppliers, an impact on our ability to perform the corresponding services or contractual obligations and where applicable, prevent Gruma from sending you marketing or advertising material in relation to our services and products.
- Gruma will maintain and implement the adequate protection actions and mechanisms, which will consist in the necessary administrative, physical and technical measures, in view of its capacity and the type of Data being treated. The foregoing will ensure the security, integrity and privacy of the Data.
- Access to Data and Limiting Processing
- Gruma is responsible for the collection, safeguard and treatment of the Data. At any time you may exercise your right to access and/or limit the Processing of your Data by contacting Gruma on the details set out at the beginning of this Privacy Policy.
- If at any time you wish to correct or delete Data we hold about you that is inaccurate, out-of-date, incomplete, irrelevant or misleading, please contact us on the details set out at the beginning of this Privacy Policy and we will amend this record or provide written notice in case there is a reason why we cannot amend it or is required to retain the Data to the extent permitted by law. If you wish to have your Data deleted, please let us know by contacting us on the details above and we will take all reasonable steps to delete it unless we need to keep it for legal, auditing or internal business reasons.
- We must point out that, in limiting or deleting your Data as requested, the same consequences as described in Paragraph 2 above could apply. If this is the case, Gruma will inform you of the consequences in further detail depending on the specific Data.
- You may also contact us by e-mailing us on the details above if you have a complaint about how we have Processed your Data. If Gruma becomes aware of any ongoing concerns or problems concerning our privacy practices, we will contact you about the issue, investigate the issue, and take all reasonable steps to work with you to resolve the issue.
- With respect to all of the above, you may, by contacting Gruma on the details set out at the beginning of this Privacy Policy:
- check whether we hold or use your Data and request access to such data;
- request that we correct any of your Data that is inaccurate, incomplete or out-ofdate;
- request that your Data is retained by us only as long as necessary for the fulfilment of the purposes for which it was collected; and
- withdraw, in full or in part, your consent given previously, in each case subject to any applicable legal restrictions, contractual conditions and a reasonable time period as well as the consequences as mentioned above.
- Retention of Data
Gruma may keep the Data and that of other individuals that you provide to us for a reasonable period in accordance with legal requirements following your cessation of business dealings / employment with us. - Transfer and Disclosure of Data
- Gruma may disclose and/or transfer the Data, both to individuals and entities, either within Singapore or abroad (including Mexico). The recipients of such Data will be subject to the provisions of this Privacy Policy
- It is possible that Gruma requires transferring your Data to third parties with whom it maintains business or professional relations. Also, Gruma may disclose and/or transfer Data corresponding to the Personnel, Customers and Suppliers to third parties such as regulatory authorities, companies within the Gruma group of companies, third party organizations or service providers including their professional service providers (e.g., external firms, laboratories and/or clinics, administrators).
- Such third parties will receive the Data only and exclusively as part of the business and/or professional relationship with Gruma, as part of the scope and/or as information that is necessary to perfect the internal, business and/or professional relations created among Gruma and the Data Subjects. Gruma will only select third parties who formally agree to implement the necessary security measures to ensure the adequate level of privacy of the Data. Gruma will be responsible for notifying all third parties the content of this Privacy Policy, as well as any modification or cancellation of Data arising from the exercise of the rights made at any time by any of the Data Subjects.
